Frequently Asked Questions About Bankruptcy

In New York state, there are specific requirements for filing bankruptcy. In many cases, clients will qualify to keep their homes, cars and other assets while repaying other debt on payment plans. This page is meant to provide you with some basic information, but since every case is different, please call me personally for a free consultation at one of our three Rochester area locations. I am a bankruptcy lawyer who will give you the attention you need to relieve you of collection harassment and keep your house, car and personal property.

What Is Bankruptcy?

Bankruptcy is a legal declaration of inability or reduced ability to repay creditors and start fresh. The two most common types of bankruptcy are Chapters 7 and 13.

What Is Chapter 7?

Chapter 7 is a liquidation proceeding. Assets are liquidated and the proceeds are distributed among creditors. Most Chapter 7 cases are resolved in a few months and allow you to retain your assets, while eliminating debt.

What Is Chapter 13?

Chapter 13 is a reorganization of debts. Debts are adjusted, consolidated and scheduled to be repaid over a period of time. Chapter 13 debt issues can often be resolved with a three- to five-year, interest-free payment plan with no foreclosure or forfeiture of assets.

Why Declare Bankruptcy?

To stop foreclosure or repossession, to end collections harassment or wage garnishment, to get you back on your feet, to get a fresh start.

When Will I See Results?

Once your case is filed with the court, all collections activity must stop. Your creditors may then only communicate with our office and you'll be free to answer your phone again.
